Calverton Aviation & Technology (CAT) has filed an amended complaint in its breach of contract action against the Town of Riverhead to correct a procedural defect. The filing of the original complaint was procedurally defective as CAT failed to file a notice of claim with the town clerk prior to commencing the lawsuit. However, CAT was able to re-file the suit after complying with state law, with the town’s consent. The amended complaint, filed on Feb. 23, has very little substantive difference from the original complaint. The town has until March 29 to answer or otherwise respond to the complaint, and has waived any defense pertaining to lack of jurisdiction due to CAT’s initial failure to file the notice of claim. The amended complaint includes new allegations about the town’s intentions regarding the EPCAL Property and statements made by town officials. The survival of local journalism depends on support from the community.
